Ordinance No. 04-03
An Ordinance providing for the control of dogs within the City of Grandview Plaza, Kansas, supplementing Ordinances 85-3, 91-3, and 99-1.
Be it ordained by the Governing Body of the City of Grandview Plaza, Kansas.
Section 1. Control of Animals.
It is unlawful for any person to:
1. Keep, harbor or maintain a dog within the corporate limits of Grandview Plaza, Kansas unless the person is a resident of Grandview Plaza, Kansas;
2. Allow animal waste to accumulate to the extent that it becomes a health hazard to any animal, person or the public. Any accumulation of animal waste, when not immediately removed or discarded in a sanitary manner, is considered to be a potential health hazard, i.e. feces accumulated in homes, confined yards, pens, hutches, etc. “Immediate” in this instance is defined as waste accumulation of not more that one day’s duration.
3. Allow any odors to emanate from any animal kept or harbored on the premises or to allow any odors to emanate from any feces or urine on the premises, any of which odors reasonable tend to offend any person;
4. Keep or harbor on a chain, rope or other type leash, any dog in such a manner as to allow the animal to have access to any public sidewalk, or public alley, or utility right of way or utility meter.
5. Keep or harbor on a chain, rope or other type of leash any dog in such a manner as to interfere with a persons access to the front door of a residence;
Section 2. Prohibited Dogs.
It is unlawful for any person to:
1. Keep, own or in any way possess within the city limits of the City of Grandview Plaza, Kansas, any Pit Bull Breed of dog, provided, any one (1) Pit Bull breed of dog that is in the City of Grandview Plaza, Kansas on the date this ordinance is adopted that is registered with the Grandview Plaza Police Department on forms described by the Chief of Police on or before July 1, 2004, may be kept within the City by residents of the City subject to the requirement of subsections (a) through (g) hereafter. “Pit Bull” is defined to mean: The Staffordshire Bull Terrier breed, the American Pit Bull terrier, the American Staffordshire terrier, or any dog which has the appearance and the characteristics of these breeds.
a. Registration of Pit Bulls of any age, as provided, shall be conducted at the Grandview Plaza Police Department under procedures as set forth by the Chief of Police on forms provided by the Police Department and shall include acceptable photographs provided by the keeper or owner of said dog for identification.
b. No household within the City limits of Grandview Plaza, Kansas shall keep of harbor or own any more the on Pit Bull Dog.
c. No Person shall permit a registered Pit Bull dog to go outside its kennel or pen unless such dog is securely leashed with a leash no longer that four feet in length. No person shall permit the Pit Bull dog to be kept on a chain, rope or other type of leash outside its kennel or pen unless a person is in physical control of the leash. Such dog may not be leashed to inanimate objects such as trees, posts or buildings. In addition, all such dogs on a leash outside of the animal’s kennel must be muzzled by a muzzling device sufficient to prevent such dog from biting persons or other animals.
d. All registered Pit Bull dogs shall be securely confined indoors or in a securely enclosed and locked pen or kennel, except when leashed and muzzled as above provided. Such pen, kennel or structure shall have secure sides and a secure top attached to the sides. Such pen, kennel or structure shall have a secure bottom floor attached to the sides of the pen or the sides of the pen must be embedded in the ground not less that two feet. All structures erected to house such dogs must comply with all zoning and building regulations of the City. All such structures must be kept in a clean and sanitary condition. All structures used to confine such registered dogs must be locked with a key or combination lock when such dogs are within the structure.
e. No Pit Bull dog may be kept on a porch, patio or in any part of a house or structure that would allow the dog to exit such building on its own volition.
f. The keeper or owner of a Pit Bull registered under this section shall maintain liability insurance in an amount not less that $50,000.00, which insures against injuries which may be caused by said dog. Proof of such insurance shall be provided to the Police Department at the time the animal is registered.
g. It shall be unlawful for the owner or keeper of a Pit Bull dog registered with the City of Grandview Plaza, Kansas to fail to comply with the requirements and conditions set forth in this section. Any dog found to be the subject of a violation of this section shall be subject to immediate seizure and impoundment. Failure to comply with this ordinance shall result in the immediate revocation of the license of such animal, resulting in the immediate removal of the animal from the City.
Violations and Penalties.
Section 1. Any person violating any provision of this section shall, upon conviction in court, be fined a sum not less than one hundred dollars ($100.00) and not more than five hundred dollars ($500.00)
Section 2. Any person violating or permitting the violation of any provision of this section shall, upon conviction in Court, be fined a sum of not less that three hundred dollars ($300.00) and not more that one thousand dollars ($1000.00). In addition to the fine imposed, the Court may sentence the defendant to confinement for a period not to exceed thirty (30 ) days. The Court shall order the registration of the dog revoked and the dog removed from the City or destroyed. Any person violating this section shall pay all expenses of the City incurred in enforcement of this ordinance, including shelter, food, handling, veterinary care, and if necessary, destruction of the animal.
This ordinance shall be effective upon it publication in the official newspaper of Grandview Plaza, Kansas.
